One of the most depressing subjects is this Oscar Pistorius situation. Ever since he killed his girlfriend Reeva, it has been a drag. It doesn’t help that it took forever for him to be sentenced.
We know he was sentenced to 5years after being charged with Culpable Homicide, based on Judge Masipa’s ruling last year. Fast forward to August 2015, he was supposed to be released from prison to House arrest, and that release was blocked. At the time he’d have only served 10months of his sentence.
His transfer to house arrest came through last month. He walked out of prison and now the State has made an appeal that Oscar be charged with Murder and not Culpable Homicide. This is going to open another can of worms that will drag till whenever. I personally will feel better if Oscar was to be charged with murder because that’s what I thought was gonna happen from the get go. I am not at all clued up with law but to me it seems like he got away with murder. Worse he is out of jail now way before his term is over. Like seriously?
Anyway, the prosecution argued that it didn’t matter who was behind that bathroom door, Oscar’s intent was to kill because of the number of shots he fired. They also want Oscar’s jail sentence to be increased to 15 years minimum.
According to The Guardian: The ruling will rely on a majority decision among the five judges, several of whom argued on Tuesday that the bench was indeed entitled to impose its own verdict (rather than simply order a retrial) should it accept the state’s argument. The judges could reject the state’s appeal, order a retrial (although there was no appetite for that expressed by any side today), or substitute a new verdict. If the appeal court decides to impose a guilty verdict on the murder charge, the case would return to the high court for a fresh sentence.
We know no matter what happens, Reeva is gone and not coming back. But somehow we still want justice to be served shem. We have people behind bars that are rotting for committing minor crimes. Then we have those hard core criminals that are well known ekasi roaming the streets and causing havoc everyday. They rape, rob and kill….get arrested for a few hours and then back to normal. In celebville, uJub Jub is still in jail for accidentally killing school children because he was irresponsible and reckless. Oscar serves only a year behind bars for picking up his gun, walking to his bathroom door, standing there and firing 5 shots that killed his then girlfriend because he thought she was a tsotsi. #Life
So we wait to hear what the appeal court will decide on this matter. Apparently Oscar’s lawyer was heard saying he is going to lose this time. TJO!!
